Address
of the Verkhovna Rada of Ukraine
to the Parliamentary Assembly of the Organization for Security and Co-
operation in Europe (OSCE PA) and the parliaments of its member States
regarding the unacceptability of the participation of members of the
parliament of the Russian Federation in the work of the Assembly's statutory
bodies
Highlighting the important role of the Organization for Security and Co-
operation in Europe (OSCE) in promoting peace and security, the rule of law and
human rights, and the development of democratic institutions in the area stretching
from North America to the Far East,
reiterating the unwavering position of the Ukrainian State regarding the
consistent implementation and observance of the generally recognized principles
and norms of international law, OSCE commitments, the provisions of the Final Act
of the Conference on Security and Co-operation in Europe (Helsinki Final Act of
1975) and the Paris Charter for a New Europe,
affirming that the Russian Federation, by launching an unprovoked war of
aggression against Ukraine on February 24, 2022, which became a continuation of
the ongoing Russian aggression against Ukraine since 2014 and is accompanied by
unprecedentedly cruel war crimes, crimes against humanity and acts of genocide of
the Ukrainian people, has violated all the fundamental principles of the OSCE, in
particular, such as the inviolability of borders, respect for the sovereignty and
territorial integrity of States and the non-use of force or the threat of force, and made
it impossible to fulfill the main task of ensuring comprehensive security and
implementing conflict prevention mechanisms in the OSCE region,
referring to the Address of the Verkhovna Rada of Ukraine of September 8,
2016 regarding the illegal elections to the State Duma of the Russian Federation in
the territory of the temporarily occupied Autonomous Republic of Crimea and the
city of Sevastopol and the Statement of the Verkhovna Rada of Ukraine of
September 22, 2021 regarding the non-recognition and illegality of regular elections
of deputies of the State Duma of the Russian Federation and the illegitimacy of the
parliament formed as a result of such elections; and recalling, that in 2021 the voting
for the State Duma of the Russian Federation took place in the temporarily occupied
territories of Ukraine with the involvement of Ukrainian citizens with illegally
issued passports of citizens of the Russian Federation, which is legally null and void;

underlining the futility, worthlessness and impossibility of continuing the
interparliamentary dialogue with the members of the parliament of the terrorist State,
which continues the temporary occupation and attempts to annex parts of the
sovereign territory of Ukraine and thereby demonstrates the disregard to the
fundamental principles of the OSCE and threatens the future and development
prospects of the Organization and its Parliamentary Assembly, as well as the attitude
of members of parliaments of the participating States who support such a policy of
ignoring the goals of the OSCE,
highlighting, in this context, the decision of the OSCE Parliamentary
Assembly enshrined in the Birmingham Declaration and its Resolution "The Russian
Federation’s War
of Aggression Against Ukraine and Its People, and Its Threat to
Security Across the OSCE Region” adopted at the 29
th
Annual Session of the
Assembly in July 2022, regarding the assignment to the Standing Committee of the
Assembly to make changes to the Rules of Procedure of the Assembly, which would
provide for the suspension of the mandate of the national parliamentary delegation
of an OSCE participating State in case it violates the OSCE principles and
commitments and the provisions of the Final Act of the Conference on Security and
Co-operation in Europe ( Helsinki Final Act of 1975),
condemning the immoral and insidious nature of the massive barbaric attacks
by the Russian Federation on critical civilian infrastructure of Ukraine and
residential buildings, with the aim to inflict maximum harm to the civilian
population, particularly during the winter period, and creating a large-scale
humanitarian disaster with the hope that it will undermine the will of the Ukrainian
people to resist the Russian invasion,
drawing attention to the purposeful extermination by the Russian Federation
of the Ukrainian people, objects of cultural heritage, educational and health care
institutions, ordinary multistory residential buildings, which has all the signs of
genocide; as well as to the indiscriminate rocket attacks and artillery shelling of the
objects of the united energy system of Ukraine by the Russian occupying forces,
which do not pursue any military goals and have exclusively a terrorist goal and lead
to numerous victims among the civilian population, in particular children,
recalling the purposeful multi-month blockade of Ukrainian ports by the
Russian aggressor, which provokes the world food crisis, as well as the ongoing
attempts of the Russian Federation to block work within the framework of the Black
Sea Grain Initiative and to continue food blackmail in order to promote and achieve
its aggressive and revisionist goals,

stressing that the Russian Federation continues to use the accessible
international platforms to spread disinformation and propaganda narratives in order
to mislead the States and expects to continue to do so within the framework of the
OSCE PA,
The Verkhovna Rada of Ukraine appeals to the OSCE Parliamentary
Assembly and the parliaments of its member States:
to approve the amendments to the Rules of Procedure of the Assembly, which
would provide for suspension of the mandates of the members of the OSCE PA,
representing the parliaments of the participating States violating the OSCE
principles and committing the act of armed aggression against another participating
State of the Organization, as well as to adopt the decision on such suspension of the
mandates of the members of the parliamentary delegations of the Russian Federation
and the Republic of Belarus, as well as to continue further reform of the
Organization;
to refrain from joint work with representatives of the Russian Federation and
the Republic of Belarus in the statutory bodies of the Assembly and related events
held by the Assembly, for the period until the terrorist State's attitude towards the
principles and goals of the OSCE is completely changed and the commitments
undertaken within the Organization are fully fulfilled;
to request the Governments of participating States to apply visa restrictions to
members of the parliaments of the Russian Federation and the Republic of Belarus,
who are under the sanctions of the European Union and other OSCE participating
States, as well as to call for further increase of sanctions pressure on Russia for its
aggressive war against Ukraine;
to support the Polish-Lithuanian initiative regarding the appeal to the
responsible officials of Austria and the OSCE PA to support restrictive measures
and prevent representatives of the Russian Federation from participating in the
regular Winter meeting of the OSCE PA;
to condemn the terrorist actions of the Russian Federation aimed to destroy
Ukraine, to recognize the criminal actions of the Russian Federation on the territory
of Ukraine as genocide of the Ukrainian people, and to recognize Russia itself as a
terrorist State, and make a relevant statement of the OSCE PA during the Winter
meeting;
to adopt legislative acts that would allow to settle the issue of confiscation of
frozen financial and other assets of the Russian Federation and its citizens for their
subsequent transfer to Ukraine as compensation for the damage caused by Russian
aggression, and to join the initiative to create a Special International Tribunal;

to increase sanctions pressure on the Russian Federation with the goal to stop
the war and global world crisis created by the terrorist State, and to restore
international legal order based on mutual respect and cooperation, and not on nuclear
or any other blackmail, use or threat of use of force;
significantly increase economic, financial and security assistance to Ukraine,
which will make it possible to advance the victory of the Ukrainian State in the
defensive war against the Russian Federation and restore peace, stability and
security in the world.
